The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    On Sept. 18, 2007, the plaintiff was a passenger in a vehicle traveling north on Highway 82 when one of the corporate defendant's truck drivers struck the vehicle he was riding in.

    The suit does not state how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Gilbert Harper et ux vs. A.O. Smith Corp.et al

    PA - Bryan Blevins, J - Donald Floyd

    A man and his wife have filed an asbestos suit against 18 defendant corporations, claiming the asbestos-related disease with which the man was diagnosed was wrongfully caused.

    Gilbert L. Harper worked as a painter, plumber, carpenter, fire investigator and in heating and air conditioning, where he says he was exposed to asbestos-containing products.

    This is the second asbestos lawsuit Gilbert Harper and his wife, Bonita L. Harper, have filed against the companies. In their August lawsuit, the Harpers are claiming a different asbestos-related injury than in their prior complaint.

    The couple claims the defendants failed to test the asbestos-containing products before they were introduced into the stream of commerce,

    The plaintiffs are suing for exemplary damages.

    The plaintiffs have filed an asbestos suit against 9 defendant corporations, claiming an asbestos-related disease caused by the defendants killed their benefactor.

    They claim Barbara was exposed to asbestos through family members who worked for the defendants.

    The plaintiffs claim the defendants failed to test the asbestos-containing products before they were introduced into the stream of commerce,

    The plaintiffs are suing for exemplary damages.

    A political blogger in Southeast Texas has alleged that two other local bloggers have defamed and harassed him through their Web sites.

    Philip R. Klein writes the Southeast Texas Political Review, a site that includes news and commentary about area elected officials and community leaders.

    As PRK Enterprises and Klein Investments, Klein sued the Operation Kleinwatch and Sam the Eagle blogs, as well as Google and its subsidiary blogger.com .

  • Glen Savoie vs. Union Pacific Railroad Co.

    A Bexar County man has filed suit against Union Pacific Railroad Co., alleging he sustained injuries to his hip after he was forced to jump on and off moving objects.

    Glen Savoie claims he worked for Union Pacific, and as part of his work duties, was required to mount and dismount moving equipment in Jefferson County.

    The actions caused injuries to Savoie's right hip.

    Because of his injury, Savoie has suffered lost wages and a diminished earning capacity, physical pain, physical impairment and mental anguish and incurred medical expenses, all of which will likely continue into the future, the suit states.

    On April 30, 2008, the plaintiff was traveling on I-10 when one of the corporate defendant's truck drivers struck the vehicle he was riding in.

  • Valerie Mahfood vs. Texas Department of Criminal Justice

    PA - Kelly Stewart, J - Donald Floyd

    A Jefferson County woman claiming the Texas Department of Criminal Justice has failed to fully compensate her is suing the department for more than two years' back pay.

    Valerie Mahfood states she has worked for TDCJ for 16 years at the LeBlanc Unit in Beaumont in a dual position as grievance investigator and law librarian.

    At the time Mahfood was hired to work the positions in July 1999, both positions received the same lieutenant-level pay, according to the complaint.

    In September 2005, however, the law librarian position was raised to a higher, captain-level pay and all law librarians should have received a salary increase, the suit states.

    Because Mahfood was spending a majority of her time performing law librarian duties, she contends she should have received the pay increase. However, she continued to be listed as a grievance instructor and receive only lieutenant-level pay, the complaint says.
