  • Westridge Townhomes Homeowners Association vs. Texas Windstorm Insurance Association

    PA - James Wimberley, J - Gary Sanderson

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    On June 2 the plaintiff was in an automobile collision with the defendant.

    The suit does not state how or where the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On June 2 the plaintiff was in an automobile collision with the defendant.

    The suit does not state how or where the incident occurred.

  • J.D. Roberts vs. Munro's Dry Cleaning Co.

    PA - John West, J - Donald Floyd

    A Beaumont man has filed suit against Munro's Dry Cleaning Co., alleging not all of his clothes were returned to him.

    J.D. Roberts claims he contracted with Munro's Dry Cleaning to store a large number of clothes for him.

    In September 2007, Roberts asked the items be returned to him, but a great number of the items were not given back, according to the complaint.

    "They have been either misplaced or otherwise lost by Defendant," the suit states.

    Because of his lost clothing, Roberts claims he has suffered mental anguish, has incurred out-of-pocket expenses and lost use of the items.

    The plaintiff, a bricklayer, is suing 17 defendants for allegedly conspiring to expose him to asbestos, despite actual knowledge of the dangers of asbestos.

    The plaintiff alleges the defendants conspired to inflict him with an asbestos illness.

    He is suing for exemplary damages.
