A total of six new lawsuits against insurance companies over hurricane damage claims were filed in Jefferson County District Court from Sept.7-11, 2009.
The following complaints were filed:
Juan Arellano of 2130 Victoria in Beaumont alleges Capitol County Mutual Fire Insurance Company did not properly insure his home for damages. As a result, he did not obtain money after Hurricane Ike struck on Sept. 13. In his suit, Arellano names ICA and adjuster Doug Browning as defendants because he says they should have known his claims should have been covered. Arellano is represented by Clint Brasher of Beaumont. Jefferson County District Court case number: B184-870.
Curley Babineaux of 3049 Seventh St. in Port Arthur alleges Fire Insurance Exchange denied a portion of his claim for damages to his home caused after Hurricane Rita struck on Sept. 24, 2005. Babineaux will be represented by Rocky Lawdermilk of Beaumont. Jefferson County District Court case number: E184-895.
Larry McCully of 7550 Forest Park Drive in Beaumont alleges Texas Windstorm Insurance Association undervalued his claims for damages caused to his property after Hurricane Ike struck on Sept. 13. McCully is represented by Clint Brasher and Joe Muckleroy of Beaumont. Jefferson County District Court case number: B184-872.
Larry Morton of 11135 Kenner in Beaumont alleges Texas Windstorm Insurance Association undervalued his claims for damages caused to his property after Hurricane Ike struck on Sept. 13. Morton is represented by Clint Brasher and Joe Muckleroy of Beaumont. Jefferson County District Court case number: E184-817.
Thelma and Roland Ozane of 2035 Fifth Ave. in Port Arthur allege Texas Windstorm Insurance Association undervalued their claim for damages caused to their home after Hurricane Ike struck on Sept. 13. The Ozanes are represented by Clint Brasher and Joe Muckleroy of Beaumont. Jefferson County District Court case number: A184-873.
Walter Umphrey Cancer Center, 4600 Ninth Ave. in Port Arthur, alleges Truck Insurance Exchange underpaid a portion and denied other claims for damages caused to the center's business after Hurricane Humberto struck on Sept. 13, 2007. The cancer center will be represented by J. Steve Mostyn of The Mostyn Law Firm in Houston. Michael R. Ramsey and Gregory F. Cox of Beaumont will serve of counsel.
