Sept. 21

  • Angela Lavergne et al vs. Voyager Indemnity Insurance Co.

    PA - Steve Mostyn, J - Bob Wortham

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Renaldo Smith vs. Valerie Fisher

    PA - Timothy Ferguson, J - Donald Floyd

    On March 12 the plaintiff was traveling north on I-10 when the defendant allegedly failed to control her speed and struck him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    n July 14, 2008, the plaintiff was stopped at a red light on College Street when the plaintiff, who was an employee of defendant Stallion Oilfield at the time of the incident, rear-ended her.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On March 22 the plaintiff and defendant were in an automobile collision at 4700 Park St. in Beaumont.

    The suit does not state how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Thomas Pitts et al vs. Patriot Security

    PA - Tommy Yeates, J - Gary Sanderson

    On behalf of the late Ellen Pitts, the plaintiff is suing her former employer for refusing to allow her to seek medical treatment on Feb. 18, which resulted in her death.

    The plaintiff claims she asked her supervisor for permission to leave and seek medical treatment but was told to stay at her post until a replacement guard arrived.

    She died later that day of a bilateral pulmonary embolism.

    The plaintiff is seeking exemplary damages.

    Shamyra Kelly vs. The Medical Center of Southeast Texas et al

    PA - Jim Perdue Jr., Milton Shuffield

    On April 8, 2008, the plaintiff, who is suing on behalf of her minor child, brought the child in for a surgery.

    Shortly after the anesthetic was administrated, the child went into cardiac arrest and died.

    The plaintiff alleges the defendants failed to correctly administer the anesthetic.

    The plaintiff is seeking all wrongful death damages.

    On Nov. 27, 2007, the plaintiff was shopping at the defendant's store when he cut himself on a piece of glass.

    He claims the store's employee failed to cut and wrap the glass before giving it to him.

    He is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.
