Nov. 13

  • Carlton Johnson vs. Felonda Thomas

    PA - David LaRue, J - Bob Wortham

    On Oct. 20, 2008, the defendant was traveling north on 6th Street at Calder Avenue when the defendant allegedly failed to yield the right-of-way and struck his vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Bill Taylor et al vs. Texas Windstorm Insurance Association

    PA - Steve Mostyn, J - Bob Wortham

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Larry Lawson vs. Raquel West

    On Aug. 11, 2005, the defendant was appointed by a court of law to represent the plaintiff in a criminal matter.

    The plaintiff alleges he had a mental disorder that should have prevented him from standing trial.

    The plaintiff alleges the defendant owed him a legal duty to bring his disorder to the attention of the court.

    He is suing for $850,000.

  • Eric Vanderhoeff vs. T.A. Operating

    PA - Travis McCall, J - Bob Wortham

    On June 30, 2008, the plaintiff pulled up to a diesel pump on the defendant's place of business on Walden Road.

    While he exited his truck, he stepped into a puddle of diesel fuel and slipped and fell.

    The plaintiff alleges the defendant negligently failed to maintain its premises and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Peter Loukas FROGS Construction et al

    PA - Dan Ducote Jr., J - Bob Wortham

    The plaintiff hired the defendants to install new hardwood floors in his home.

    However, the defendants have allegedly left the floors in a state of disrepair, causing moisture to enter the floors and buckle.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Gary Cornwell vs. Dr. Lawernce Hill and Phillip Coleman et al

    PA - Pro se, J - Milton Shuffield

    The plaintiff hired the defendants as experts to testify in a Jefferson County civil case, paying them a $3,000 retainer.

    On April 1 Coleman advised the plaintiff that he could not testify because he was about to undergo surgery and said he would refund the retainer.

    However, the defendant died from surgical complications and the retainer was never refunded.

  • Neal Elk vs. Spartan Offshore Drilling et al

    On March 2 the plaintiff was working as a welder on the defendant's offshore rig when he was injured.

    The plaintiff alleges the defendant negligently failed to provide a safe workplace and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Charles Dees and Mary Guidroz vs. AMF Incorporated et al

    PA - Glen Morgan, J - Bob Wortham

    A Vidor couple has filed an asbestos suit against more than 100 corporate defendants, alleging the companies negligently used asbestos insulation on their premises.

    Charles Dees and Mary Guidroz filed suit against AMF Incorporated, along with 99 other defendants.

    A few of the defendants listed in the suit include BP, A.W. Chesterton and Chevron.

    According to the suit, the plaintiff was a truck driver and regularly visited the defendants' premises. The suit does not specify which plaintiff was the truck driver.

    However, medical records attached to the suit say Dees, a smoker, had occupational asbestos exposure from 1950 to 1980 and was diagnosed with lung cancer in April 2007.

    The plaintiffs are seeking exemplary damages.

  • Sharon Zerko vs.Regency Nursing and Rehabilitation Centers

    PA - Clay Dugas, J - Milton Shuffield

    In the midst of the chaos during the evacuation of Hurricane Ike in September 2008, Cindy Zerko fell out of her wheel chair and fractured her hip.

    Two weeks later, Zerko died.

    Now her daughter, Sharon Zerko, is suing the Regency Nursing and Rehabilitation Centers, alleging the senior center negligently failed to "to initiate an effective fall prevention program."

    The plaintiff is suing for wrongful death damages.

  • Betty Lou vs. Chevron USA

    PA - Keith Hyde, J - Donald Floyd

    A widow has filed suit against Chevron USA, alleging the oil giant negligently exposed her late husband, Billy Cunningham, to asbestos and inflicted him with mesothelioma.

    Provost Umphrey attorney Keith Hyde filed the personal injury lawsuit on Betty Lou's behalf.

    "During Cunningham's employment with Gulf Oil, he used and was exposed to toxic materials including asbestos dust and/or fibers," the suit said.

    "As a result of such exposure, he developed an asbestos-related disease, mesothelioma, for which he died a painful and terrible death on Feb. 11, 2009."

    The suit alleges that the oil conglomerate knew for decades that asbestos-containing products could cause the disease asbestosis and other asbestos-related cancers but still allowed its employees to work with and around the naturally occurring mineral.

    The plaintiff is suing for exemplary damages.
