Man sues insurance company for denying medical claim

A Jefferson County man says his insurance companies wrongfully denied his claim for benefits under his medical policy.

David W. Mayer filed a lawsuit Nov. 24 in Jefferson County District Court against Golden Rule Insurance Co. and United Healthcare Insurance Co.

Mayer claims the insurance companies should be legally obligated to pay him benefits pursuant to the terms under his policy, but breached its obligations when it denied Mayer's benefits.

"The evidence at trial will show that Golden Rule Insurance Company and United Healthcare Insurance Company justified its recision of the policy by claiming plaintiff made a material representation on his application for insurance," the suit states. "This was untrue."

Mayer seeks a recovery for his damages, plus statutory and treble damages, attorney's fees, costs, pre- and post-judgment interest, costs and other relief the court deems just.

Jonathan C. Juhan of Beaumont will be representing him.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
