Auto product liability suit filed over death in Orange wreck

E. Todd Tracy, the Dallas attorney specializing in automobile product liability cases, has filed a suit in a local court over a man killed in a collision in Orange.

On Dec. 2, Tracy filed suit in Jefferson County District Court on behalf of Eddron Smith, deceased, his wife Lakethia and their two minor children against Hyundai Motor Co., Jesus Rocha and Towanna Lowe.

According to the suit, Eddron Smith was riding with Lowe in a 2003 Hyundai Sonata in Orange on May 23, 2008. They were traveling southbound on Edgar Brown Drive when Lowe failed to yield the right-of-way and struck Rocha's vehicle, causing Smith to be ejected from the vehicle.

"At the time of the accident, Smith was properly seated and properly wearing his three-point seat belt," the suit states. "However, despite being properly restrained, Smith sustained fatal injuries when the vehicle in which he was riding failed to protect him."

The plaintiffs allege Hyundai negligently designed its vehicle.

The suit also blames Rocha and Lowe for failing to obey traffic laws.

The plaintiffs are seeking economic damages.

Judge Milton Shuffield, 136th Judicial District, has been assigned to the case.
