A total of six new lawsuits against insurance companies regarding hurricane damage claims have been filed in Jefferson County District Court, Nov. 23-Dec. 4, 2009.
The following lawsuits were filed:
Mary Edwards of 1321 Gulfway Drive in Port Arthur claims Texas Windstorm Insurance Association denied her claim for roof, water, wind, foundation and structural damages caused to her property after Hurricane Ike struck on Sept. 13, 2008. TWIA denied the claim after its Vice President of Claims Reggie Warren assigned All-Tech Claims Management and adjusters Ken Colestock, Jacob Crowley and Rhett Lee to investigate. Edwards will be represented by Gregory F. Cox of The Mostyn Law Firm in Beaumont. Jefferson County District Court case number: A185-400.
Alicia Pedraza has filed suit against Fire Insurance Exchange, alleging the defendant insurance company has denied at least a portion of the plaintiff's Hurricane Ike claim. The plaintiff claims the insurance company has refused to honor its policy and fully compensate for damages inflicted. In addition to breach of contract, the suit accuses the insurance company of deceptive trade violations and several Texas Insurance Code violations. The plaintiff is represented by the Mostyn Law firm. Case No. B185-441
Lady Savoie of 5820 Clint Lane in Beaumont alleges Texas Windstorm Insurance Association denied her claim for damages caused to her property after Hurricane Ike struck on Sept. 13, 2008. Lonnie Smith, along with his wife Louise, has filed suit against the Texas Farmers Insurance Co., alleging the defendant insurance company has denied at least a portion of the plaintiff's Hurricane Ike claim. The plaintiff claims the insurance company has refused to honor its policy and fully compensate for damages inflicted. In addition to breach of contract, the suit accuses the insurance company of deceptive trade violations and several Texas Insurance Code violations. The plaintiff is suing for actual and consequential damages, plus attorney's fees. The plaintiff is represented by the Mostyn Law firm. Case No. A185-436
Melissa Widner has filed suit against the Texas Windstorm Insurance Association, alleging the defendant insurance company has denied at least a portion of the plaintiff's Hurricane Ike claim. The plaintiff claims the insurance company has refused to honor its policy and fully compensate for damages inflicted. In addition to breach of contract, the suit accuses the insurance company of deceptive trade violations and several Texas Insurance Code violations. Nancy Wilson has filed suit against Capitol County Mutual Fire Insurance, along with several claims adjusters, alleging the defendant insurance company has denied at least a portion of the plaintiff's Hurricane Ike claim. The plaintiff claims the insurance company has refused to honor its policy and fully compensate for damages inflicted. In addition to breach of contract, the suit accuses the insurance company of deceptive trade violations and several Texas Insurance Code violations. The plaintiff is suing for actual and consequential damages, plus attorney's fees. The plaintiff is represented by the Mostyn Law firm. Case No. B185-422
