Nederland man sues over collision on Cardinal Drive

A Nederland man is suing the driver he says rear-ended him while he was driving on West Cardinal Drive in Beaumont.

Jack L. Sedtal claims he was operating a vehicle on May 8, 2008, when defendant Richard K. Phelps failed to control his speed and struck the rear of Sedtal's vehicle. At the time of the collision, Phelps was working for co-defendant Norman Highway Constructors.

Because of the incident, Sedtal suffered injuries to his neck, spine and shoulders; experienced physical and mental strain, pain, suffering and anguish; and lost income, according to the complaint. In addition, Sedtal incurred medical costs, experienced emotional distress and lost wages, the suit states.

Phelps negligently failed to keep a proper lookout, drove too fast, failed to drive in a safe manner and failed to apply his brakes to avoid a collision, the complaint says.

Sedtal is seeking an unspecified judgment, plus interest, costs and other relief to which he may be entitled.

Lance P. Bradley of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
