Suit filed against driver who caused rear end collision

Three Jefferson County residents have filed suit against the driver who they claim rear-ended them.

Patrick Scott, Shanna Scott and Sylvan Floria claim they were riding in a vehicle when defendant John Tran failed to stop for traffic and hit their vehicle from behind on June 29.

At the time of the accident Tran was working for defendant Sears, according to the complaint filed Jan. 21 in Jefferson County District Court.

Because of the accident, the plaintiffs incurred medical costs; experienced pain, suffering, mental anguish and loss of enjoyment of their lives; and lost wages, the suit states.

Tran negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to yield, failed to maintain a proper distance, failed to swerve to avoid a collision, failed to sound his horn and failed to control his speed, the complaint says.

The plaintiffs are seeking an unspecified judgment, plus interest, costs and other relief to which they may be entitled.

John S. Morgan of Harris, Duesler and Hatfield in Beaumont will be representing them.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
