Woman sues Beaumont Wal-Mart over slip on wet substance

A Beaumont woman claims she sustained "catastrophic injuries" after falling on liquid at a Beaumont Wal-Mart.

Benita Davis filed a lawsuit Jan. 21 in Jefferson County District Court against Wal-Mart Stores.

Davis claims she visited the Wal-Mart located at 4145 Dowlen Road on Feb. 3, 2008, when she slipped and fell on a liquid on the floor.

"Defendant Wal-Mart Stores Inc. was aware of the liquid on the floor prior to Plaintiff's fall, yet there were no warning signs in the area," the suit states. "Such knowledge was aware by a store employee coming to the liquid with paper towels in hand."

Because of her fall, Davis incurred medical costs; lost earnings and her earning capacity; and experienced physical impairment, physical pain, mental anguish and disfigurement, according to the complaint.

She blames Wal-Mart for causing her fall, saying employees failed to warn her of a dangerous condition.

Davis seeks an unspecified judgment, plus pre-judgment interest, costs and other relief to which she may be entitled.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
