A personal injury trial against Conn's Appliances slated to begin this month has been continued to sometime in June.
Defense attorney Gerald Wayne Riedmueller of Beaumont argued for the continuance on Monday, Feb. 8, before Judge Milton Shuffield, 136th District Court.
A courthouse employee told the Southeast Texas Record the plaintiff had not finished processing people for depositions, so the defendant asked for more time.
Plaintiff Lola Jones filed suit against Conn's in May 2008, alleging one of the company's truck drivers rear-ended her on March 6, 2008.
According to her suit, Jones was traveling westbound in a 1998 Pontiac Sunfire in the 1000 block of Edgebrook in Houston. She had come to a stop when Juan Landa, a Conn's truck driver, struck her vehicle."
Although the incident transpired in Harris County, Jones argues that the case belongs in Jefferson County because Conn's has a principal office here.
"Nothing plaintiff did, or failed to do, caused the occurrence in question," the suit states. "Rather, it was the negligence of the defendants."
Jones alleges Landa failed to keep a proper lookout and apply his brakes in a timely manner, in addition to alleging that Conn's negligently hired and trained Landa.
On top of damages for mental anguish and physical pain, Jones is also seeking actual and exemplary damages.
