Woman hit by car pulling out of driveway, sues driver

A woman has filed suit against the driver who she says struck her as the driver was pulling out of her driveway.

Katie Wellman claims she was driving in the 6000 block of Delaware Street in Beaumont on May 14, 2008, when defendant Catherine Wallace pulled out of a private driveway and struck her.

According to the complaint filed March 5 in Jefferson County District Court, Wellman incurred medical costs and suffered mental anguish and disfigurement because of the accident. In addition, she lost wages and experienced pain and suffering, the suit states.

Catherine Wallace negligently failed to control her speed, drove too fast, failed to keep a proper lookout, failed to maintain a safe distance between the vehicle she was operating and Wellman's, failed to swerve to avoid a collision, failed to bring the vehicle she was operating to a stop, failed to timely apply her brakes and drove carelessly, the complaint says.

At the time of the collision, Catherine Wallace was driving a vehicle John Wallace lent to her. But Wellman claims John Wallace should never have let Catherine Wallace borrow his vehicle because he knew her to be a reckless driver.

In her complaint, Wellman seeks actual damages within the jurisdictional limits of Jefferson County District Court, pre- and post-judgment interest, costs and other relief the court deems just.

Ryan Douglas White and Jason L. Cansler of Brent Coon and Associates in Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
