A bank claims a Newton County man and a Hardin County man owe it a Harley Davidson after they defaulted on payments they owe to the bank.

Compass Bank filed a lawsuit April 5 in Jefferson County District Court against Willie Boughner and Jesse Hays.

Compass Bank claims it executed a retail installment contract and security agreement with Boughner and Hays in Beaumont. To secure the debt, Boughner and Hays granted Compass Bank a security interest in a 2007 Harley Davidson XL 1200C, according to the complaint.

Since the contract's execution, Boughner and Hays defaulted on it, and as of March 16, owe $10,340.24 on it, the suit states.

Because they defaulted on the note, Boughner and Hays are required to peacefully turn over the Harley Davidson to Compass Bank, but refuse to do so, the complaint says.

Now, the bank wants the court to order a sheriff or constable to seize the vehicle from Boughner and Hays.

It also wants the court to grant it judgment for the money it says Boughner and Hays owe it, plus attorney's fees of at least $1,500, costs, post-judgment interest and other relief the court deems just.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
