A Houston man claims he incurred medical costs after becoming injured while working for two railroads.
Ricardo Matamoros filed a lawsuit June 1 in Jefferson County District Court against Union Pacific Railroad Co. and the Kansas City Southern Railway Co.
Matamoros claims he was performing duties for the railroads on May 8 when he sustained injuries. In his complaint, Matamoros fails to specify how he was injured or the nature of his injuries. Matamoros only alleges that because of his injuries, he incurred medical costs, lost wages and his earning capacity and experienced physical pain, mental suffering and physical impairment.
Matamoros says Union Pacific employees negligently cut cars on a curve and an improperly aligned drawbar and failed to provide him with a safe place to work. KCS breached its duty to exercise ordinary care for his safety and failed to keep the track in proper condition, according to the complaint.
In his complaint, Matamoros seeks a judgment within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs and other relief to which he may be entitled.
Rodney V. Steinburg, Michael L. Herzik and M. Lucia Prieto of Steinburg, Herzik and Prieto will be representing him.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
