Two Beaumont residents blame two drivers for causing their injuries after both drivers entered a Beaumont intersection at the same time.
Linda Marie Maple and Nina Ward filed a lawsuit June 8 in Jefferson County District Court against Aubrey Daniel Allen and Marcus Anthony Maple.
Linda Marie Maple and Ward claim they rode in a vehicle Marcus Anthony Maple drove south on Houston Street on March 11 when it came to a stop at Houston's intersection with Corley Avenue.
The Maple vehicle began to proceed through the intersection when Allen, who drove east on Corley, entered the intersection at the same time and the vehicles collided.
Because of the collision, Linda Marie Maple and Ward incurred medical costs and experienced physical pain, suffering, physical impairment and mental anguish, according to the complaint. In addition, Ward lost earnings and her earning capacity, the suit states.
The plaintiffs blame both Allen and Marcus Anthony Maple for causing the collision, saying both drivers failed to keep a proper lookout, failed to turn their vehicles to avoid a collision, failed to stop at an official traffic control device, failed to grant immediate use of the intersection to each other after they had already entered the intersection and failed to enter the intersection only when it appeared safe to do so.
In addition, Marcus Anthony Maple negligently failed to brake in a timely manner, the complaint says.
In their complaint, Linda Marie Maple and Ward seek a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief to which they may be entitled.
