On behalf of her minor son, Laura Utterback has filed suit against three individuals whom she holds responsible for injuries her son suffered after a motorist struck him.
The suit was filed June 3 in Orange County District Court and names Brittany Frazier and Jesse and Rodney Wurtz as defendants.
Court documents show that on Oct. 20, 2009, the minor child "was playing in the front yard" of his Vidor home when Frazier struck him with her vehicle.
The suit does not specifically state how the Wurtzs were involved and negligent.
Frazier is accused of negligently failing to keep a proper lookout, apply her brakes and travel at a safe rate of speed.
The plaintiffs are suing for past and future mental anguish, medical expenses and lost wages, plus all court costs.
They are represented by attorney Timothy Ferguson.
The case has been assigned to Judge Buddy Hahn, 260th Judicial District.
