A man claims his co-worker backed into him as he attempted to work.
Willie Kennedy filed a lawsuit June 9 in Jefferson County District Court against Acme Truck Line and Elway McCray.
Kennedy claims he was working at Metal Forms when Acme Truck Line's vehicle, which was being operated by McCray, backed into Kennedy.
Because of the incident, Kennedy sustained serious and permanent injuries, incurred medical costs, lost his earning capacity and endured mental anguish, according to the complaint. In addition, he suffered physical impairment, lost his household services, suffered physical disfigurement and lost consortium, the suit states.
Kennedy blames McCray for causing the incident, saying he failed to keep a proper lookout, failed to timely apply his brakes, failed to use a spotter, failed to warn, failed to instruct, failed to keep his vehicle under proper control and failed to keep a proper lookout.
In his complaint, Kennedy seeks actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief to which he may be entitled.
He will be represented by Gilbert T. Adams III of the Law Offices of Gilbert T. Adams in Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
