Water near freezer leads to fall, suit against market

A Jefferson County man claims he sustained injuries to his neck and back after falling on water near a grocery store's freezer.

Eddie Bell filed a lawsuit June 15 in Jefferson County District Court against M D Market, Paul D. Nguyen and Melinda P. Tran.

Bell claims he entered M D Market, located at 3225 Park St. in Beaumont, on Dec. 18 and headed to the freezer area to find grocery items when he slipped and fell on accumulated water.

In addition to his injuries, Bell incurred medical costs, lost wages, experienced pain and suffering and endured mental anguish, according to the complaint.

Bell blames the defendants for causing his fall, saying they negligently failed to inspect the premises on a regular basis, failed to adequately dry the floor, failed to place signs warning invitees of the wet floor, failed to make the premises safe with the use of mats, failed to instruct their employees to maintain a hazard-free environment and failed to supervise their employees to ensure the safety of their patrons.

In his complaint, Bell seeks a judgment within the jurisdictional limits of the court, plus pre- and post-judgment interest, costs and other relief the court deems just.

Michael R. McGown of Benckenstein, Norvell and Nathan in Beaumont will be representing him.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
