A Florida man claims a Jefferson County driver rear-ended his vehicle as he drove in Port Arthur.
David Dame filed a lawsuit July 6 in Jefferson County District Court against Latoya Chaisson.
Dame claims he drove a 2005 silver Nissan Pathfinder southeast on Texas State Highway 347 near Texas State Highway 73 in Port Arthur when he stopped for a red light. Suddenly, Chaisson, who drove a white four-door sedan behind him, collided with his vehicle, according to the complaint.
Because of the collision, Dame incurred medical costs; experienced physical pain, suffering, mental anguish and physical impairment; and lost his earning capacity, the suit states.
He blames Chaisson for causing the collision, saying she failed to maintain a proper lookout, failed to take proper evasive action, followed him too closely and drove inattentively.
In his complaint, Dame seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.
Beth S. Janicek of the Law Offices of Beth S. Janicek in San Antonio will be representing him.
The case has been assigned to Judge Gary Sanderson, 60th District Court.
Jefferson County District Court case number: B187-217.
