A Louisiana resident has filed a lawsuit after a pickup truck failed to yield the right of way and struck his vehicle.
Philip Guidry filed suit against James Stark on July 19 in Jefferson County District Court.
The incident occurred on July 21, 2008, as Guidry was traveling eastbound on Interstate 10 near the Washington Street exit in Beaumont. Guidry states Stark's 1995 C1500 pickup truck struck his vehicle.
The defendant is accused of negligence for failing to yield the right of way, failing to control his speed, failing to drive with reasonable care, and failing to keep his vehicle under proper control at all times.
The plaintiff is seeking damages for physical pain, mental anguish, medical expenses, physical impairment, physical disfigurement, loss of any earnings and earning capacity, interest and court costs.
