A Jefferson County couple has filed suit against the driver who they blame for causing a collision.
Randall and Patty Hardy claim they were riding in a vehicle heading north on Highway 366 on May 22, 2009, when defendant Chester Broussard, who was driving a vehicle owned by defendant William Dean Stratton doing business as Stratton Construction, suddenly failed to control his speed and struck them.
Because of the collision, the Hardys incurred medical costs, lost earnings and their earning capacity and suffered physical pain and mental anguish, according to the complaint filed July 29 in Jefferson County District Court. In addition, they sustained physical impairment and physical disfigurement, the suit states.
Broussard negligently failed to maintain a proper lookout, failed to maintain proper control, failed to give appropriate attention to the vehicle's operation, failed to control his speed, failed to timely apply his brakes, failed to take evasive action and failed to use reasonable care, the complaint says.
In their complaint, the Hardys are seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
