GALVESTON - La Marque Development Corp. claims Highland Park Development Co. displaced it from ownership of land, recent court documents say.
According to a lawsuit filed Aug. 16 in Galveston County District Court, Highland Park Development Co. unlawfully entered upon and dispossessed La Marque Development Corp. of three tracts of Highland Park and Highland Park Annex.
"The plaintiff was, and still is, entitled to legal possession of the property, and the defendant still withholds possession," the original petition says.
The plaintiff's predecessor - collectively known as the Smiths - obtained possession of the land in question in 1950.
The Smiths raised cattle and sold soil and sand from the property, which was surrounded by a fence. They transferred ownership to the plaintiff last year.
La Marque Development Corp. asks Galveston County 10th District Court Judge David Garner to award it the title to the land.
