GALVESTON - Claiming a shopping center was not built in accordance to its design specifications, Friendswood Plaza Inc. seeks unspecified monetary damages from Judson Coward Inc., Doans & Associates LLC and Kenall Inc.
Friendswood Plaza's breach of contract lawsuit, filed Aug. 13 in Galveston County Court No. 2, alleges each defendant has contributed to the poor construction of South Friendswood Plaza Shopping Center.
The four parties executed a valid and enforceable contract in March 2004, according to the plaintiff.
Judson Coward was responsible for building the strip mall while Doans drew the plans and Kenall conducted the inspections.
Court papers assert that the plaintiff fully performed its contractual obligations and obediently paid the defendants.
The suit faults Judson Coward of failing to construct a sturdy foundation and an effective drainage system, arguing the alleged negligence resulted in structural failure.
Doans is accused of not properly monitoring Judson Coward as the latter constructed the property, and Kenall is blamed for not ensuring that the foundation specifications were met.
Attorney A.G. Crouch of Alvin is representing the plaintiff.
The case has been assigned to Galveston County Court No. 2 Judge C.G. "Trey" Dibrell.
