Woman wants more than $75,000 after rear-end collision

TYLER-A Texas woman is asking the Court for more than $75,000 after a Louisiana man rear-ended her vehicle.

Courtney Calhoon filed suit against Mallie B. Bamburg and Kerry V. Mondello, doing business as Modello Scaffolding & Shoring Co. Inc. on Aug. 25 in the Eastern District of Texas, Tyler Division.

The accident occurred Sept. 4, 2009, as Calhoon was traveling on Interstate Highway 20 west of Canton. According to the lawsuit, defendant Bamburg, in his employer's vehicle, collided into the rear of the Calhoon vehicle.

The defendants are accused of failing to keep a proper lookout, failing to make a timely application of his brakes, failing to control his speed, failing to control his vehicle, following too closely and failing to keep an assured clear distance from the vehicle he was following.

The plaintiff is seeking more than $75,000 in damages for physical pain, impairment, mental anguish, medical expenses, interest and court costs.

Calhoon is represented by Douglas J. McCarver of Nacogdoches. Jury trial is requested.

U.S. District Judge Leonard E. Davis is assigned to the case.
