Woman sues over Nederland wreck

A Nederland woman claims her insurance company refuses to pay her for damages she sustained in an automobile accident with an under insured driver.

Tonya Humphries filed a lawsuit Aug. 19 in Jefferson County District Court against Liberty Mutual Insurance Co.

Humphries claims she drove south on 27th Street in Nederland on Nov. 13, 2008, when Victoria Leigh Goebel, who drove east on Ave. G, proceeded into an intersection and into the path of Humphries' vehicle, striking it.

Because of the collision, Humphries sustained injuries to her left wrist, left arm and body and incurred medical costs. In addition, she experienced extreme physical pain, suffering and mental anguish, according to the complaint.

At the time of the collision, Humphries had insurance with defendant Liberty Mutual Insurance Co. The policy should have provided protection against collisions with under insured motorists, the suit states.

After settling a claim with Goebel and her insurance carrier, Humphries pursued a claim with Liberty. However, the insurance company has refused to respond to her claim, the complaint says.

In her complaint, Humphries seeks an unspecified judgment, plus pre- and post-judgment interest, attorney's fees, costs and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
