Fall from roof leads to lawsuit

GALVESTON - Kevin Harris of League City has filed suit against Wayne Smith over injuries reportedly sustained from a fall off a roof last year.

Harris's suit says that Smith, also of League City, invited the plaintiff over to his residence on Oct. 21, 2009, to work on his roof.

The suit was filed Sept. 7 in Galveston County District Court.

Court papers state that Smith chose to repair his roof using slick metal sheeting.

Harris and the defendant performed the work when signs of inclement weather began to appear. They subsequently cleared the roof of tools and equipments and proceeded to descend from the area in an attempt to avoid the probable storm.

It had not started to rain at that point, but the air was very humid and damp, causing moisture to collect on the metal roofing material, the suit says.

The plaintiff explains that the accumulation resulted in him slipping and hurting his left heel and femur.

He claims the injuries required hospitalization and multiple surgeries.

Consequently, Harris seeks unspecified monetary damages.

Attorney J. Michael Hughes of League City is representing the plaintiff, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
