Plaintiff Alleges Negligence Against Former Employer Pepsi-Cola Over Workplace Injury

In a dramatic turn of events, a worker has filed a lawsuit against his former employer and a supervisor following a severe workplace accident. Damien Williamson lodged the complaint on March 28, 2025, in the District Court of Harris County, Texas, accusing Pepsi-Cola Metropolitan Bottling Company, Inc., and Simeon Masiga of negligence that led to his life-altering injuries.

The case centers around an incident that occurred on January 3, 2025. Williamson was working at the Pepsi-Cola warehouse located at 5300 LaPorte Fwy., Houston, Texas when he was involved in an accident involving forklifts. According to the complaint, while standing beside his forklift during his shift, another forklift operated by his coworker Dwight reversed without ensuring a clear path and collided with him. This resulted in Williamson being crushed between two forklifts. The injuries sustained were severe: a fractured left leg, torn calf muscle, fractured knee, two torn tendons in the knee, and deep punctures through the back of his knee. Due to these injuries, Williamson has been unable to fulfill his job responsibilities and has incurred significant medical expenses.

Williamson's legal team argues that both defendants failed in their duty of care towards him. The plaintiff accuses Pepsi-Cola Metropolitan Bottling Company of not providing a safe working environment and failing to implement adequate safety measures. Specifically, they are accused of neglecting to hire competent employees or provide necessary safety equipment and training. Similarly, Simeon Masiga is alleged to have failed in supervising operations safely at the warehouse.

The lawsuit claims that these failures constitute negligence on part of both defendants which directly led to Williamson's injuries. The complaint further asserts that these actions displayed "a severe degree of risk" with conscious indifference towards employee safety. As such, Williamson seeks monetary relief exceeding $1 million for damages including past and future lost wages; medical expenses; pain and suffering; mental anguish; impairment; disfigurement; as well as attorney fees.
