Bank sued for wrongful foreclosure

A Port Arthur woman has filed suit against the bank that she claims wrongly foreclosed on her property.

Keice L. East claims defendant HSBC Bank foreclosed on her Port Arthur property on July 6.

However, the bank never should have done so because East had entered into an agreement with defendant Ocwen Loan Servicing regarding a loan modification, according to the complaint filed Sept. 9 in Jefferson County District Court.

Although East never received confirmation that the loan modification agreement had been accepted, she says her property should not have been foreclosed upon, the suit states.

East only became aware of the foreclosure when she received an eviction notice on Aug. 9, the suit states.

Now, East wants the court to issue a temporary restraining order preventing the bank from foreclosing on the property, the complaint says.

She also seeks injunctive relief, actual and exemplary damages, pre- and post-judgment interest, costs, attorney's fees and other relief the court deems just.
