Port Neches man sues over auto collision

A Port Neches man claims he suffered physical pain and mental anguish after a driver failed to control his speed and struck him.

Bryan Snipes filed a lawsuit Sept. 23 in Jefferson County District Court against Jose Duran and Alfredo Lopez.

Snipes claims he was driving in Jefferson County when Duran failed to control his speed and caused a collision on Sept. 18, 2009. At the time of the accident, Duran was working for Lopez, according to the complaint.

In addition to his physical pain and mental anguish, Snipes lost earnings, suffered damage to his earning capacity and sustained disfigurement, the suit states. He also suffered physical impairment, incurred medical costs and sustained property damage, the complaint says.

Snipes blames Duran for causing the collision, saying he failed to control his speed, failed to maintain a proper lookout, failed to timely apply his brakes, failed to drive in a safe manner, failed to maintain control of his vehicle and failed to yield the right of way.

In his complaint, Snipes seeks actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Matthew C. Matheny of Provost and Umphrey Law Firm in Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
