Provost Umphrey files petition to perpetuate testimony in possible asbestos case

Darlene Beard has filed a petition to perpetuate the testimony of Steven Beard, a former Texaco employee who is stricken with lung cancer.

Through Provost Umphrey attorney Keith Hyde, the petition was filed Oct. 11 in Jefferson County District Court. The anticipated defendants in the pending suit are Texaco and Chevron.

The petition does not state how Steven Beard and Darlene Beard are connected.

According to the petition, Steven Beard was diagnosed with lung cancer and the "disease is expected to progress, ultimately proving fatal."

"The substance of the testimony which petitioner expects to elicit involoves Mr. Beard's employment and exposure history at Texaco," the suit state, adding that the petitioner alleges his condition was a result of asbestos exposure.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
