Claiming loss of benefits, former worker sues Total Petrochemicals

A former Total Petrochemicals employee has filed suit against the company, claiming that miscalculation has resulted in the loss of his retirement benefits.

Lee Soliz filed the suit under the Employer Retirement Income Security Act on Oct. 20 in Jefferson County District Court.

In his suit, Soliz claims his benefits were "inaccurately calculated" by Total.

"As a result of defendant's wrongful conduct, plaintiff ... has suffered a loss of benefits," the suit states. "Plaintiff alleges the miscalculation of his retirement benefits was an abuse of discretion by the administrators of the plan."

Soliz is suing for all benefits due and owing.

The plaintiff is represented by Port Arthur attorney Jill Chatelain of McPherson, Hughes, Bradley, Wimberly, Steele & Chatelain.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
