Wachovia sues three over $100K note

Wachovia Bank wants the court to order three men to repay it more than $100,000 for a promissory note they guaranteed nearly four years ago.

The bank filed a lawsuit Oct. 13 in Jefferson County District Court against Mark Clapp, Michael Johnson and Randy Chamberlain.

Wachovia claims Clapp, as president of Clapp and Chamberlain Management, executed a promissory note on Dec. 13, 2006. Since then, however, the company has defaulted on its payments, according to the complaint.

Wachovia has demanded the remaining money from the defendants, who guaranteed the note, but they have refused to pay the money, the suit states.

"Accordingly, there is now due, owing and unpaid from Defendants to Plaintiff, on the Note, the sum of $112,658.59," the complaint says.

In addition to the money it says the defendants owe it, Wachovia seeks pre- and post-judgment interest, attorney's fees, costs and other relief the court deems just.

Terry W. Wood of Beaumont will be representing it.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
