Mom, kids sue other driver after collision

A Beaumont woman has filed suit against the driver who she claims failed to yield the right-of-way when turning.

Julie Gregory, individually and as next friend of Nicholas and Stephen Gregory, claims she was driving north in the 7900 block of Helbig Road in Beaumont with her children in the vehicle on Nov. 12, 2008, when the collision occurred.

Defendant Danielle Roberts, who was turning south from the 4700 block of Gager Avenue, failed to yield the right-of-way to Julie Gregory and slammed into her vehicle, according to the complaint filed Oct. 14 in Jefferson County Circuit Court.

Because of the accident, Julie Gregory has suffered headaches and severe neck, shoulder, elbow and knee pain while her sons have suffered severe anxiety, the suit states.

In addition, the plaintiffs incurred medical costs; lost earnings and their earning capacity; suffered physical impairment, physical pain, mental anguish and disfigurement; and incurred property damages, the complaint says.

Julie Gregory blames Roberts for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes and failed to stop or yield the right-of-way.

In her complaint, Julie Gregory is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
