Plaintiff claims continuing headaches caused by crash

A Jasper County man claims he suffers from headaches and severe neck, shoulder and elbow pain after a driver rear-ended him as he slowed to turn into a driveway.

John Girard filed a lawsuit Oct. 13 in Jefferson County District Court against Ricardo and Stacey Guadarrama.

Girard claims he drove on Broussard Road on Nov. 2, 2008, when he slowed to turn into a driveway. Suddenly, Ricardo Guadarrama, who drove a vehicle owned by Stacey Guadarrama behind him, failed to control his speed and slammed into the rear of Girard's vehicle, according to the complaint.

In addition to his injuries, Girard incurred medical costs, lost earnings and his earning capacity, suffered physical impairment and pain and endured mental anguish and disfigurement, the suit states. He also incurred property damages, the complaint says.

Girard blames Ricardo Guadarrama for causing the collision, saying he negligently failed to keep a proper lookout, failed to timely apply his brakes to avoid a collision and failed to control his speed.

In his complaint, Girard seeks an unspecified judgment, plus interest, costs and other relief the court deems just.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
