Man claims driver followed too closely

A Beaumont man has filed suit against the driver who he claims followed his vehicle too closely, causing a collision.

Ismael Z. Nunez claims he was driving at the intersection of Lucas Drive and Lufkin Stret in Beaumont on Oct 14, 2008, when defendant Kevin P. Sparrow struck his vehicle.

Because of the accident, Nunez incurred medical costs; experienced pain, suffering, mental anguish and physical impairment; and lost wages, according to the complaint filed Oct. 12 in Jefferson County District Court.

Sparrow negligently failed to exercise due care, failed to keep a proper lookout, failed to timely apply his brakes, failed to keep his vehicle under control and failed to swerve to avoid a collision, the suit states. In addition, Sparrow failed to use his horn's vehicle to warn Nunez of the impending collision and followed Nunez too closely, the complaint says.

In his complaint, Nunez is seeking an unspecified judgment, plus costs, pre- and post-judgment interest and other relief the court deems just.

Jeffrey C. Chilton of Packard Lapray in Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
