Nursing home blamed for patient's fall, death

On behalf of Leroy Bernard, Mary Bernard has filed a wrongful death suit against the owner of The Oaks of Beaumont, alleging the nursing home allowed him to fall and hit his head.

Mary Bernard filed the suit against Pinnacle Health Facilities of Texas on Nov. 10 in Jefferson County District Court.

Court papers show that Bernard was admitted to The Oaks on Sept. 18, 2009. On Oct. 12, 2009, he fell and hit his head. Bernard was rushed to Christus Hospital St. Elizabeth, where a CT scan showed a massive subdural hematoma on the left side of his brain.

Bernard died later that evening, court papers say.

The suit alleges The Oaks negligently failed to assign nurses to supervise Bernard's care and prevent the fall.

The plaintiff is suing for all wrongful death damages allowable under law.

She is represented by Beaumont attorney Clay Dugas.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
