Alleging Maxim Crane Rentals employee Joseph Eckert ran a red light and struck their vehicle, Edjus and Ester Daigle have filed suit against both the company and employee.
The suit was filed Nov. 19 in Jefferson County District Court.
Court papers show that on Dec. 22, 2008, the Daigles were traveling on Main Street in Port Arthur when Eckert, while in the course and scope of his employment with Maxim, "disregarded his red light on SH 87" and struck them.
"This negligent collision resulted in the injuries and damages complained of herein," the suit states.
The plaintiffs allege Maxim negligently entrusted Eckert, and also accuse Eckert of negligently failing to keep a proper lookout.
They are seeking damages for their alleged mental anguish, medical expenses, impairment and lost wages.
They are represented by Beaumont attorney Jonathan Juhan.
Judge Milton Shuffield, 136th District Court, has been assigned to the case.
