Woman claims ex improperly filed divorce proceedings

A Harris County woman claims she remained unaware of her husband's petition for divorce until she attempted to file one herself.

Noelia Ayala Sunesara filed a lawsuit Nov. 19 in Jefferson County District Court against her former husband, George J. Prappas, and Robert J. Connor.

Sunesara claims she attempted to initiate divorce proceedings against Prappas, when her attorney, Scott P. Ogle, discovered a previous divorce petition Prappas had filed on Jan. 17, 2003.

When she reviewed the divorce petition, Sunesara discovered that someone other than her had signed her name to the divorce document filed in Jefferson County District Court.

As a result of the divorce, which was finalized without Sunesara's realization, she claims she is entitled to unliquidated damages and exemplary damages.

In her complaint, Sunesara alleges fraud and breach of contract against the defendants.
She seeks actual damages, injunctive relief, pre- and post-judgment interest, costs, attorney's fees and other relief the court deems just.

Scott P. Ogle of the Law Office of Scott P. Ogle in Austin will be representing her.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
