A Hardin County man has filed suit against the driver who allegedly lost control of her vehicle, causing it to repeatedly strike a concrete wall.
Gary Bach claims he was riding in a vehicle Shirley Billot was driving on Highway 69 in Beaumont on Dec. 11, 2008, when the incident occurred at the overpass at Tram Road.
"Defendant Shirley Billot failed to control her speed and her driver inattention was a contributing factor to this accident," the suit filed Dec. 8 in Jefferson County District Court states. "Obviously, liability clearly exists on the part of the Defendant, Shirley Billot."
Because of the accident, Bach sustained permanent bodily impairment, experienced scarring and lost his earnings and his earning capacity, the complaint says. In addition, he claims he incurred medical costs.
Billot negligently failed to keep a proper lookout, drove too fast, failed to turn to avoid the collision, failed to timely apply her brakes, failed to keep proper control of her vehicle and failed to keep a proper lookout, according to the complaint.
In his complaint, Bach is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
He will be represented by Stephen N. Williams of The Williams Firm in Beaumont.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
