Trip to post office ends in wreck and lawsuit

A Beaumont man has filed suit against the driver who he claims failed to control her speed and collided with him.

Ronald Vaughns claims he was attempting to make a left-hand turn into the post office on Avenue A in Beaumont when defendant Pamela Carol Davis-Metz failed to control her speed and struck him on Aug. 25, 2009.

Because of the accident, Vaughns experienced cervical neck and back pain and incurred medical costs, according to the complaint filed Dec. 28 in Jefferson County District Court.

In addition, he suffered physical pain, suffering and mental anguish, the suit states.
Vaughns blames Davis-Metz for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to avoid the incident, failed to control her speed and failed to maintain her vehicle, the complaint says.

In his complaint Vaughns is seeking a judgment in excess of the minimum judgment of Jefferson County District Court, plus costs, pre- and post-judgment interest at the highest legal rate and other relief to which he may be entitled.

David J. LaRue of Loncar and Associates in Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
