Slip-and-fall lawsuit filed against Macy's

Orange resident Nell Sparks is suing Macy's Corporate Services, claiming a "dangerous condition" at its Beaumont store caused him to slip and fall.

The suit was filed Jan. 20 in Jefferson County District Court.

According to the petition, on Oct. 27 Sparks was shopping at the Macy's at Parkdale Mall when "a dangerous condition caused him to slip and fall."

The suit does not say what Spark's stepped in or where or how the incident occurred.

The suit only accuses Macy's of negligently failing to inspect its premises for "slick substances," which in "all likelihood" could cause harm to patrons.

Sparks claims he suffered serious and permanent injuries in the fall and is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus exemplary damages.

Provost Umphrey attorney Paul Ferguson Jr. of Beaumont represents him.

Judge Bob Wortham, 58th District Court, has been assigned to the case.

Case No. A189-198
