Man says wreck caused physical, mental strain

A Harris County man incurred mental and physical strain after a driver pulled into his path and struck his vehicle.

Larry A. Harvey filed a lawsuit Jan. 26 in Jefferson County District Court against Jack P. Ward, Lloyd's Register Energy Americas formerly known as Lloyd's Register Capstone, and Enterprise Leasing Co.

In his complaint, Harvey claims he rode in a vehicle traveling west in the 3400 block of FM 365 in Port Arthur on Feb. 12, 2009, when Ward, who drove a vehicle for Lloyd's owned by Enterprise, pulled into his path.

Because of the collision, Harvey sustained injuries to his left knee, causing mental and physical strain, and suffered great pain and mental anguish, the suit states. In addition, he lost income, incurred medical costs and suffered emotional distress, the complaint says.

Harvey blames Ward for causing the collision, saying he negligently failed to keep a proper lookout, failed to control his speed, failed to drive in a safe manner and failed to apply his brakes.

Because it employed Ward at the time of the collision, Lloyd's should be held liable for any injuries he caused, the suit states.

In his complaint, Harvey seeks an unspecified judgment, plus interest at the legal rate, costs and other relief to which he is entitled.

Lance P. Bradley of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
