Employee sues KCS for injury

Beaumont resident Dustin Kruse is suing his employer, Kansas City Southern Railway Co., for injuries he received last May.

The suit was filed Feb. 16 in Jefferson County District Court.

According to his petition, on May 15, 2010, Kruse "suffered injuries while in the course and scope of his employment for the defendant, KCSR."

The suit does not state how Kruse was injured or where the incident occurred. Nor does the suit specifically state how KCSR was negligent in causing his alleged injuries.

"The injuries ... were caused by in whole or in part by the negligence of KCSR," the suit states, adding that Kruse was in no way responsible for causing the incident.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
