The son of the late Daniel Oney has filed suit against his father's former employer, Kansas City Southern Railway Co., for allegedly exposing him to asbestos.
Under the Federal Employers Liability Act, Ronald Oney filed his suit Feb. 25 in Jefferson County District Court.
From 1971 to 1994, Oney was employed by KCSR and worked throughout Jefferson County, according to the lawsuit.
During his employment, Oney was allegedly exposed to asbestos and diesel exhaust. As a result, he was diagnosed with lung caner on April 28, 2010, and died June 2, the suit alleges.
The suit continues by alleging KCSR knew of the dangers yet still exposed workers to harmful substances.
The plaintiff is suing for his father's alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Houston attorney Mark Berry of Sammons & Berry represents the plaintiff.
Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
