Injured driver claims motorist failed to control his speed, sues

Mississippi resident Jacque Nelson has filed suit against Port Arthur local Luis Garcia, alleging he failed to control his rate of speed and struck her vehicle.

The suit was filed Feb. 24 in Jefferson County District Court.

Court records show that on Feb. 6, 2010, Nelson was traveling west on Highway 365 and had stopped to make a left turn onto Medical Center Drive in Port Arthur when "Garcia failed to control his speed and rammed his pick-up truck into the back of plaintiff's vehicle."

The suit also accuses Garcia of driving in a negligent and reckless manner, failing to take evasive action and failing to apply his brakes in time.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
