One Stop Construction settles wrongful termination case

Morgan

Last April, a local judge dismissed a wrongful termination suit against One Stop Construction and Restoration, but then reinstated the case two months later.

Rather than continue litigating, One Stop settled with plaintiff Temple Willett on Monday, March 14.

A court official told the Southeast Texas Record that the company would present a final judgment for approval later this week.

As previously reported, Judge Milton Shuffield, 136th District Court, ruled in April 2010 that Willett, a Louisiana resident, failed to prove his breach of contract case against One Stop.

However, on June 22 the judge granted Willett's motion for new trial, officially reinstating the case against the construction company

Court records show that Willett filed suit against One Stop in December 2008, alleging the company terminated him without the three-year notice required under his employment contract.

Willett and One Stop entered into a written employment agreement Jan. 23, 2007, which stated Willett was to be employed as a superintendent and make $800 per week, in addition to a weekly vehicle allowance of $125, court documents show.

Under the terms of the agreement, Willett was to be paid the wages for the entire employment term, and if either he or One Stop wished to terminate the agreement, they would be required to submit a three-year notice.

Willett was suing for an award of lost wages and the contractually agreed upon interest.

Port Arthur attorney Peter Doyle Jr. represented Willett.

One Stop was represented by Beaumont attorney John Morgan.
