Biker sues driver over wreck

A man has filed suit against the driver he claims struck him as he rode on his motorcycle.

Samuel Distefano claims he was driving on Highway 365 on Oct. 3, 2009, when defendant Garrett Michael Cloud collided with him.

According to the complaint filed March 7 in Jefferson County District Court, Distefano incurred medical costs, experienced mental anguish and disfigurement and lost wages because of the collision. In addition, he sustained pain and suffering, according to the complaint.

Cloud negligently failed to control his speed, drove too fast, failed to keep a proper lookout, failed to maintain a safe distance between his vehicle and Distefano's, failed to swerve to avoid a collision, failed to bring his vehicle to a stop and failed to timely apply his brakes, the suit states.

In his complaint, Distefano is seeking actual damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
