Nome man sues Finch A/C, claims sold faulty unit

A Nome man has filed suit against Finch Air Conditioning & Heating, alleging the La Porte company sold him a faulty A/C unit.

Josh Dunagan filed his suit under the Texas Deceptive Trade Practices Act on March 21 in Jefferson County District Court.

According to his petition, Dunagan hired Finch Air to install a brand new HVAC unit in his home.

"Defendant represented that the HVAC unit was new and that it was of the best quality," the suit states. "The representations made by the defendant were false."

The suit does not state when the unit was purchased and installed, but does allege the unit has continuously leaked and damaged Dunagan's home.

Dunagan is suing to recover actual damages and court costs, plus attorney's fees.

Beaumont attorney Matthew Matheny of Provost Umphrey represents him.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
