Two people have filed suit against a driver who they claim injured two minors in an accident.
Dina Bates and Jimmy Due claim minors Tracie Dixon and Jesse Due were riding in a vehicle on July 16, 2008, when they sustained the injuries in a collision.
The plaintiffs do not state how the collision occurred and do not allege any claims of negligence against defendant David A. Henson. Bates and Due only say they had previously settled a suit with Henson, but need to bring their current suit because the minors were not able to claim damages in the previous complaint.
"No suit has previously been brought by Plaintiffs as a result of the injuries/damages received as a result of the accident of July 16, 2008, or by anyone else on their behalf," the suit states.
In their complaint, Bates and Due are seeking an unspecified judgment, plus other relief the court deems just.
Kevin Fuller of Henry and Fuller in Beaumont will be representing them.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
